Wailea Beach Villas Condominium Development

The Wailea Beach Villas Condominium Development is a 99-unit luxury condominium development on the Island of Maui, consisting of seven buildings with detached garages and a penthouse building, which has two towers with a lobby in between. The $100 million project also included roadways, guest parking areas, pools and spas, other water features, and landscaping.

During construction, the general contractor on this multiprime project encountered unanticipated delays and disruptions due to changes required because of inadequate contract documents. With no time extensions granted to address the required changes and having to accelerate its performance, the contractor retained Jacobs Associates to provide an analysis of its entitlement to an equitable adjustment of the contract price for additional delay, acceleration, disruption, and extra work-related costs it incurred. Following a detailed review of the project records, Jacobs Associates set forth its opinions in a comprehensive report and ultimately provided expert testimony in arbitration hearings, which resulted in a successful resolution of the dispute.
